ANTITRUST
Kenny Nachwalter has a national reputation for excellence in antitrust law. The firm’s antitrust practice consistently receives the highest rankings in peer review surveys. The firm’s antitrust practice has received a tier “1” ranking by U.S. News & World Report in a survey based on a rigorous evaluation process that includes the collection of client and lawyer evaluations, peer review from leading attorneys in their field, and review of additional information provided by law firms as part of the formal submission process. The firm’s antitrust practice has received similar tier “1” rankings in other surveys such as Chambers USA, and the firm’s three senior active antitrust lawyers are regularly named to the Florida Super Lawyers list by their peers.
The firm typically represents specific clients, such as large public and private corporations, privately-held companies, and individual entrepreneurs in plaintiff’s antitrust cases. The firm does not accept Plaintiffs’ Antitrust Class Action cases, because we believe clients’ actual, particular and individual interests should be the foremost concern in the representation.
The firm has considerable trial experience and has tried a number of antitrust cases, which is one of several characteristics that separates the firm from others.
Although the firm’s antitrust practice includes defense work in federal and state courts and before government agencies, most of our antitrust practice is on the plaintiff’s side in which we represent clients with problems with competitors or suppliers. We have represented clients in competitor cases in such industries as:
- Airline
- Automobile
- Dairy
- Electronic payments
- Grocery
- Insurance
- Real estate
- Rental car
- Pharmaceutical
- Publishing
- Telecommunications
- Transportation
- Shipping industries
Supplier cases involve domestic or international cartels. We have been involved in the civil prosecution of most cartel cases exposed by the enhanced incentives in the United States Department of Justice’s Corporate Amnesty Program in the mid–1990s. For example, we have represented clients in cartel cases involving vitamins, citric acid, polyurethane foam, sorbates, graphic electrodes, rubber chemicals, ethylene propylene diene monomer, packaged seafood, cathode ray tubes, styrene butadiene rubber, lithium ion batteries, carbon black, hydrogen peroxide, ferroalloys, polychloroprene, and others.
We have likewise represented clients in most of the antitrust cases filed against pharmaceutical companies for restraining generic drug entry since passage of the Hatch-Waxman Act in 1984.
Because of our expertise in antitrust, the firm’s lawyers have taught antitrust law, have served as special assistant attorneys general prosecuting or advising several States, and have published articles on antitrust law.
